Terms of Use

1. About the Service

FundaSnap provides an AI-powered tutoring service delivered via WhatsApp, aligned to the South African CAPS curriculum for Grades 3–12. The service includes text-based tutoring, photo and PDF analysis, quizzes, study plans, flashcards and study notes.

FundaSnap is operated by FundaSnap SA, a South African business. We reserve the right to modify, suspend or discontinue any part of the service at any time with reasonable notice where possible.

2. Eligibility and Accounts

FundaSnap is intended for South African learners in Grades 3–12 and their parents, guardians and teachers.

• Users under 18 must have the consent of a parent or guardian to use the service
• Each WhatsApp number may only have one FundaSnap account
• You are responsible for maintaining the security of your WhatsApp account
• You must provide accurate information during onboarding (grade, language)

Parents and guardians who become aware that a minor is using FundaSnap without their consent should contact us at hello@fundasnap.co.za to have the account reviewed.

3. Credits and Payments

How credits work

• FundaSnap operates on a credit system. Each AI interaction (question, photo, quiz, study plan etc.) costs 1 credit.
• New users receive 50 free credits upon completing onboarding.
• The free daily challenge question costs 0 credits.
• Referral bonuses of 20 credits are awarded to both parties when a new user signs up via a referral link.
• Credits do not expire.

Purchasing credits

• Credits may be purchased via Yoco using a South African debit or credit card.
• All prices are in South African Rand (ZAR) and inclusive of VAT where applicable.
• Credits are added to your account within minutes of confirmed payment.

Credit pricing

Current pricing: R20 for 50 credits · R50 for 150 credits · R150 for 500 credits. Prices may change with 14 days' notice to active users.

4. Acceptable Use

You agree not to use FundaSnap to:

• Submit harmful, abusive, threatening, defamatory or illegal content
• Attempt to cheat, deceive or manipulate the AI system
• Use the service for any commercial purpose without our written consent
• Attempt to reverse-engineer, scrape or copy the service
• Submit content that infringes copyright or other intellectual property rights
• Impersonate another person or organisation
• Use automated systems to send bulk messages to the bot
• Share account access with others for commercial gain

We reserve the right to suspend or terminate accounts that violate these terms without refund of remaining credits.

5. Content You Send

When you send photos, PDFs, voice notes or text to FundaSnap:

• You confirm you have the right to share that content
• You grant FundaSnap a limited licence to process and analyse the content solely to provide the tutoring response
• You remain the owner of your content
• Media is not permanently stored beyond the immediate processing required for the response

Please do not send content containing other people's personal information, confidential business information, or content you do not have the right to share.

6. AI-Generated Responses

• FundaSnap is a study aid — it is not a substitute for a qualified teacher or tutor
• Responses should be verified against official CAPS materials, textbooks and teacher guidance
• FundaSnap is not responsible for any academic outcomes, marks or results
• For examination-critical content, always verify responses against your textbook and teacher

We continuously improve our AI prompts and models to improve accuracy, but cannot guarantee error-free responses at all times.

7. Intellectual Property

All content on the FundaSnap website, including text, graphics, logos, and the service design, is owned by FundaSnap SA and protected by South African copyright law.

The FundaSnap name, logo and brand are trademarks of FundaSnap SA. You may not use them without our written permission.

AI-generated tutoring responses produced for you are provided for your personal educational use only. They may not be reproduced, resold or distributed without permission.

8. Limitation of Liability

To the maximum extent permitted by South African law:

• FundaSnap is provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental or consequential damages arising from use of the service
• Our total liability for any claim shall not exceed the amount you paid for credits in the 3 months preceding the claim
• We are not liable for service interruptions caused by WhatsApp, Google, Supabase or other third-party providers

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Termination

You may stop using FundaSnap at any time by sending "stop" to the WhatsApp bot. This will unsubscribe you from all proactive messages.

We may suspend or terminate your account if:

• You violate these Terms of Use
• Your account is used for fraudulent or abusive purposes
• We are required to do so by law

On termination, unused credits are forfeited unless termination was caused by our breach of these terms, in which case we will refund remaining credits at their purchase value.

10. Governing Law

These Terms of Use are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

These terms constitute the entire agreement between you and FundaSnap SA regarding your use of the service and supersede any prior agreements.

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
